Technology Failures: While Nexus Chart Trader is designed to assist in managing risk, technology can fail. Potential points of failure include, but are not limited to: internet outages, platform crashes (NinjaTrader), data feed issues, and API connection errors. The developer is not responsible for any losses incurred due to such technological failures.

No Warranty: Nexus Chart Trader is provided on an "as-is" basis, without any warranties of any kind, either expressed or implied. This includes, but is not limited to, warranties of merchantability, fitness for a particular purpose, and non-infringement. The developer does not warrant that the software will be error-free, uninterrupted, or that it will meet your specific requirements.

3. Limitation of Liability

In no event shall the authors, developers, contributors, or distributors of Nexus Chart Trader be liable for any direct, indirect, incidental, special, exemplary, or consequential damages (including, but not limited to, procurement of substitute goods or services; loss of use, data, or profits; financial losses; or business interruption) however caused and on any theory of liability, whether in contract, strict liability, or tort (including negligence or otherwise) arising in any way out of the use of this software, even if advised of the possibility of such damage.

4. User Configuration & Responsibility

User Responsibility: You are 100% responsible for the settings and parameters you input into the Nexus Chart Trader panel. You are solely responsible for understanding the functionality of the software, configuring its parameters correctly, and for all orders placed and actions taken in your trading account. For example, if you accidentally set a risk parameter to a value far greater than intended (e.g., a $10,000 stop loss), you are fully responsible for the outcome of any trade executed with those settings. The developer is not responsible for any errors made by you or the software.

5. Refund Policy

No Refunds: Due to the nature of digital software and the issuance of a unique license key upon purchase, all sales are final. Once a license for Nexus Chart Trader is activated, we do not offer refunds.
